Policies & Governance

Benchmarking Licence

This Benchmarking Licence defines the permitted use of Fulcrium benchmarking data, reports, frameworks, materials and related information.

Fulcrium benchmarking information is provided for authorised use only and remains subject to the terms of the relevant client engagement, licence, agreement or written permission granted by Fulcrium.

Purpose

Fulcrium provides benchmarking data, comparative analysis, reports, frameworks, workshops, training materials and related outputs to support informed executive, technical and operational decision-making.

These materials are made available for the specific purpose agreed with Fulcrium and may not be used, shared, adapted or commercialised beyond that authorised purpose.

Permitted Use

Unless expressly agreed otherwise in writing, Fulcrium benchmarking data and materials are provided solely for the authorised recipient’s internal use in connection with the relevant engagement.

Use is personal, non-transferable and limited to the scope, audience, duration and purpose expressly agreed with Fulcrium.

Restrictions

Without Fulcrium’s prior written permission, Fulcrium benchmarking data, materials and outputs must not be:

  • shared with unauthorised individuals, departments, affiliates, contractors or third parties;
  • sold, sublicensed, assigned, transferred or otherwise made available to others;
  • copied, reproduced, extracted, adapted, summarised or republished;
  • used in third-party contracts, commercial proposals, tender submissions or client presentations;
  • used to develop, improve, benchmark, validate or commercialise competing products, services, methodologies, tools or datasets;
  • incorporated into software, databases, dashboards, artificial intelligence systems, retrieval systems or knowledge bases;
  • used to enable third parties to benefit from Fulcrium data or services without an appropriate licence;
  • used in a way that may misrepresent Fulcrium’s conclusions, data, methodology or professional judgement.

No Transfer of Rights

Fulcrium retains all rights, title and interest in its benchmarking data, reports, frameworks, methodologies, intellectual property and intellectual capital.

No licence, right, title or interest is transferred except to the limited extent expressly agreed in writing by Fulcrium.

Benchmarking Data

Fulcrium benchmarking data is provided as part of Fulcrium’s accumulated comparative intelligence and is protected by copyright, database rights, contractual restrictions and other applicable intellectual property rights.

Benchmarking data may not be separated from Fulcrium’s reports, analysis, context, assumptions or interpretive commentary unless expressly authorised in writing.

Confidentiality

Fulcrium materials may contain confidential information, proprietary analysis, comparative intelligence and commercially sensitive information.

Authorised recipients must protect such materials from unauthorised access, disclosure, copying, extraction or misuse.

Attribution and Third-Party Use

Where Fulcrium expressly authorises publication, citation or third-party disclosure of benchmarking information, the authorised user must identify Fulcrium as the source and include appropriate disclaimers.

Such disclaimers should make clear that Fulcrium data and materials are provided “as is”, without warranty to third parties, and that Fulcrium accepts no responsibility or liability to third parties for their use or interpretation.

Artificial Intelligence and Automated Systems

Fulcrium benchmarking data, reports, frameworks and materials must not be used to train, fine-tune, validate, benchmark, optimise or operate artificial intelligence systems, large language models, retrieval systems, knowledge bases or automated analytical tools without Fulcrium’s prior written permission.

Fulcrium does not consent to the ingestion, embedding, extraction or automated repurposing of its benchmarking data, materials or intellectual capital.

Suspension or Revocation

Fulcrium may suspend, restrict or revoke access to benchmarking data, materials or services where, in Fulcrium’s reasonable opinion, there has been unauthorised use, misuse, breach of licence terms or conduct likely to affect the integrity or reputation of Fulcrium’s services, data or intellectual capital.

Engagement Agreements

Where a Benchmarking Engagement Agreement, client contract, statement of work, licence agreement or other written agreement applies, Fulcrium's Benchmarking Agreement shall take precedence in the event of conflict with this general Benchmarking Licence.

This Benchmarking Licence replaces any specific contractual licence terms agreed with Fulcrium.

Permission Requests

Requests to reproduce, share, adapt, cite, license or otherwise use Fulcrium benchmarking data, reports, frameworks or materials should be submitted to Fulcrium in writing before any proposed use.
