Policies & Governance

Training Terms

These Training Terms define the permitted use of Fulcrium training programmes, workshops, coaching sessions, materials and related intellectual property.

Fulcrium training materials are provided for authorised learning and professional development purposes only and remain subject to the terms of the relevant client engagement, training agreement or written permission granted by Fulcrium.

Purpose

Fulcrium provides training programmes, workshops, coaching sessions, presentations, handouts, worksheets, manuals, videos and related materials to support the development of benchmarking capability, technical understanding and executive decision-making.

These materials are prepared using Fulcrium’s accumulated comparative intelligence, intellectual frameworks, proprietary benchmarking methodologies and professional experience developed over many years.

Permitted Use

Unless expressly agreed otherwise in writing, Fulcrium training materials are provided solely for the personal learning and internal professional development of authorised delegates.

Delegates may use training handouts and worksheets for their own personal reference, provided that the materials are not altered, redistributed, republished, incorporated into other materials or used to train others.

Restrictions

Without Fulcrium’s prior written permission, Fulcrium training materials and programme content must not be:

  • copied, reproduced, adapted, translated, republished or redistributed;
  • shared with unauthorised individuals, departments, affiliates, contractors or third parties;
  • uploaded to shared drives, intranets, knowledge systems, learning platforms or external repositories;
  • used to teach, train, coach, advise or brief other individuals;
  • used to create internal training programmes, external courses, workshops, coaching materials or derivative learning products;
  • incorporated into proposals, reports, presentations, manuals, websites or marketing collateral;
  • used to develop, improve, benchmark, validate or commercialise competing products, services, methodologies, tools or datasets;
  • used within artificial intelligence systems, retrieval systems, knowledge bases or automated analytical tools.

Recording and Confidentiality

Recording of Fulcrium training programmes, lectures, workshops, coaching sessions, advisory calls or virtual meetings by delegates is not permitted unless expressly authorised in writing by Fulcrium.

Delegates are expected to maintain the confidentiality of training content, discussion materials, benchmarking examples, comparative information and any confidential information shared during sessions.

Mobile phones and other devices should be switched off or set to silent during training sessions, lectures and workshops unless their use has been approved for the session.

Training Materials and Intellectual Property

Fulcrium retains all rights, title and interest in its training materials, programme designs, videos, presentations, frameworks, worksheets, manuals, benchmarking examples and related intellectual property.

No licence, right, title or interest is transferred except to the limited extent expressly agreed in writing by Fulcrium.

Intellectual Capital

Fulcrium’s training programmes are not generic learning products.

They are developed from accumulated comparative intelligence, intellectual frameworks, interpretive judgement, analytical methodologies, benchmarking experience and original terminology developed through decades of independent benchmarking.

Training attendance or access to training materials does not grant any right to reproduce, teach, commercialise, disclose or otherwise use Fulcrium’s intellectual capital beyond the authorised training purpose.

Artificial Intelligence and Automated Systems

Fulcrium training materials, programme content, recordings, transcripts, examples, frameworks and related outputs must not be used to train, fine-tune, validate, benchmark, optimise or operate artificial intelligence systems, large language models, retrieval systems, knowledge bases or automated analytical tools without Fulcrium’s prior written permission.

Fulcrium does not consent to the ingestion, embedding, extraction, automated summarisation or automated repurposing of its training materials, programme content or intellectual capital.

Participation and Conduct

Delegates are expected to participate professionally and respectfully in Fulcrium training programmes, workshops and coaching sessions.

Fulcrium may suspend or remove participation where conduct is disruptive, unauthorised recording occurs, confidentiality is breached or training materials are misused.

Photographs, Video and Event Media

Attendance at a Fulcrium training programme, workshop, seminar or event constitutes acknowledgement that photographs, video recordings and other visual media may be captured during the course of the event.

Fulcrium may use such photographs, recordings and related media for legitimate business purposes including internal documentation, training, quality assurance, promotional materials, marketing communications, presentations, publications, websites and social media.

Where an attendee has notified Fulcrium in advance that they do not wish to appear in photographs or recordings, Fulcrium will use reasonable endeavours to accommodate that request where practicable.

Nothing in this section permits the recording, photographing or filming of Fulcrium training sessions by delegates without Fulcrium’s prior written permission.

Testimonials and Commendations

Fulcrium may incorporate testimonials, commendations or feedback provided by delegates, clients or participants into promotional, marketing, website, presentation or business development materials.

Where required by applicable law or where the testimonial identifies an individual, Fulcrium will take appropriate steps to ensure that use is lawful and proportionate.

Engagement Agreements

Where a client agreement, training agreement, statement of work, licence agreement or other written agreement applies, these Training Terms supplement the specific contractual terms agreed with Fulcrium.

In the event of any inconsistency, the order of precedence shall be determined by the applicable written agreement executed by Fulcrium.

Permissions and Licensing

Requests to reproduce, share, adapt, cite, licence or otherwise use Fulcrium training materials, programme content or related intellectual property should be submitted in accordance with Fulcrium’s Permissions & Licensing Policy.
